Limits of Liability for Unauthorized Transfers:
You may be held liable, within the limitations described below for an unauthorized electronic fund transfer or a series of related unauthorized transfers as follows:
- If you notify the Farmers State Bank within two business days after learning of the loss or theft of the access device, your liability shall not exceed the lesser of $50.00 or the amount of unauthorized transfers that occur before notice to the Farmers State Bank.
- If you fail to notify the Farmers State Bank within two business days after learning of the loss or theft of the access device, your liability shall not exceed the lesser of $500.00 or the sum of:
- $50.00 or the amount of unauthorized transfers that occur within the two business days, whichever is less; and
- the amount of unauthorized transfers that occur after the close of two business days and before notice to the Farmers State Bank, provided the Farmers State Bank establishes that these transfers would not have occurred.

Farmers State Bank business days and hours of operation:
For purposes of this disclosure, our business days are:
Monday through Friday 8:00 AM to 3:00 P.M. (Lobby)
8:00 AM to 5:00 P.M. (Drive Up Window)
Saturday 8:00 AM to 11:00 AM (Lobby and Drive Up Window)
Holidays are not included.
Types of Transfers covered by this Disclosure:
- Transfers resulting from debit-card transactions (even if no part of the transaction is electronic)
- Direct deposits and withdrawals
- Any transactions initiated through an electronic terminal (ATM, telephone, computer, magnetic tape, etc.) for the purpose of debiting or crediting an account.
For this disclosure, Access Devices shall mean the following:
An access device is a card, code, or other means of access to your account that may be used for the purpose of initiating electronic fund transfers. The Farmers State Bank may issue an access device to you only:
(A) In response to your request
(B) As a substitution or renewal of an existing validated access device
(C) If the device is not validated. In this case, the devices must be accompanied by an explanation that the device is not validated, how to validate it, and a complete disclosure of your rights and liabilities is the devise is validated. When the Farmers State Bank has activated an access device to enable you to use it to initiate an electronic transfer, the device is considered Avalidated@ or an Aaccepted@ access device.
Documentation of Transfers:
For any account to or from which EFT transactions can be made, The Farmers State Bank must provide you a statement at least quarterly, and a monthly statement for each monthly cycle in which an EFT transaction has occurred.
For each electronic fund transfer, the periodic statement (or documents accompanying the statement) will reflect the following:
- The amount of the transfer (this amount may include ATM charges).
- The date on which the transfer was credited or debited to your account.
- The type of transfer and the type of your account (e.g., checking, savings) to or from which funds were transferred.
- For each transfer that was initiated at an electronic terminal, either the terminal location or the terminal identification number that was on the terminal receipt. If the terminal identification number is used, the statement must also show either the address of the terminal, or a generally accepted name for its location, or the name of the business where the terminal is located.
- The name of any third party to or from whom funds were transferred.
The periodic statement must also show:
- The number of the account for which the statement is issued
- Fees or charges to the account for EFT transactions or access
- The balance in the account at the beginning and the end of the statement period
- The address and telephone number to be used for inquiries or notice of errors
Privacy:
We do NOT disclose, and do not reserve the right to disclose, nonpublic personal information about our customers or former customers to any affiliates or to any third parties, except as permitted by law. We are permitted under law to disclose nonpublic personal information about you to our affiliates and third parties in certain circumstances. If you decide to close your account(s) or become an inactive customer, we will continue to adhere to the privacy policies and practices described in this notice.
Error-resolution procedures:
Telephone us at the telephone number or write us at the address on this disclosure as soon as you can. If you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement or receipt. We must hear from you no later than 60 days after we sent you the FIRST statement on which the problem or error appeared.
(1) Tell us your name and account number (if any).
(2) Describe the error or the transfer you are unsure about and explain as clearly as you can why you believe it is an error or why you need more information.
(3) Tell us the dollar amount of the suspected error.
If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days.
We will determine whether an error occurred within 10 business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or questions. If we decide to do this, we will credit your account within 10 business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or questions in writing and we do not receive it within 10 business days, we may not credit your account.
We will tell you the results within three business days after completing our investigation. If we decide that there was no error, we will send you a written explanation.
You may ask for copies of the documents that we used in our investigation.
Farmers State Bank's liability:
If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:
(1) If, through no fault of ours, you do not have enough money in your account to make the transfer.
(2) If the transfer would go over the credit limit on your overdraft line.
(3) If the automated teller machine where you are making the transfer does not have enough cash.
(4) If the [terminal] [system] was not working properly and you knew about the breakdown when you started the transfer.
(5) If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken.
(6) There may be other exceptions stated in our agreement with you.
Your rights to stop payment of preauthorized fund transfer:
You may stop payment of preauthorized fund transfers by contacting the Farmers State Bank either by phone, in person, or in writing at the address or phone number listed in this disclosure at least three (3) business days before the scheduled date of the transfer. You will need to supply us with the following:
- The exact amount of the electronic fund transfer
- Name of payee and such other information pertaining to said item as Farmers State Bank may request.
- Reason for the request.
Failure to furnish such information pursuant to the request for stop payment shall relieve Farmers State Bank of any liability for nay payment made contrary to this request for stop payment.
You will reimburse Farmers State Bank for all expenses and loss resulting form refusing payment pursuant to a request for stop payment, or if by reason of such payment other checks drawn by you are returned unpaid because of insufficient funds. A stop payment order is also subject to the provisions contained in your signature card.
A stop payment order is effective for six (6) months, but it lapses after fourteen (14) calendar days if the original order was oral and was not confirmed in writing within that period. A stop payment order may be renewed for additional six-month periods by a written order given to the Bank within a period during which the stop payment order is effective.
The charge for a stop order request is $7.50 per item.
Charges for EFT's:
The only fees that Farmers State Bank will charge for electronic fund transfers or for the right to make transfers will be those transfers involving the use of the Farmers State Bank Shazam7 Chek Card. A complete list of fees associated with its use is listed on the Shazam7 Chek Card application and are detailed below:
ATM Transfers - PLUS Network - types of transfers, dollar limitations, and charges
You may access your account(s) by ATM using your Shazam7 Chek Card and personal identification number, to:
- Make deposits to checking account(s)
- Make deposits to savings account(s)
- Get cash withdrawals from checking account(s)
- You may withdraw no more than $210.00 per day
- The is a charge of $1.00 per withdrawal
- Get cash withdrawals form savings account(s)
- You may withdraw no more than $210.00 per day
- The is a charge of $1.00 per withdrawal
- Transfer funds from savings to checking account(s)
- There is a $1.00 charge per transfer
- Transfer funds from checking to savings account(s)
- There is a $1.00 charge per transfer
- Get information about:
- The account balance of your checking accounts
- The account balance of your savings accounts
Some of these services may not be available at all terminals.
Point-of-Sale Transactions - dollar limitations and charges:
- You may not exceed $500.00 in transactions per day
- The charge for your card is $1.00 per month. This fee is waived if you use your card more than five times per month.
- We charge $1.00 each month if your account is set up to use ATMs.
- We will charge you $5.00 for a new debit card personal identification number.
- We will charge you $5.00 to replace a lost debit card.
Except as indicated elsewhere, we do not charge for these electronic fund transfers.
If you use an automated teller machine that is not operated by us, you may be charged a fee by the operator of the machine and/or by an automated transfer network.
